Terms of Service

1. The Service

LibraryKeeper is library management software that helps organizations catalog books, manage readers, and track lending and returns, including an optional self-service kiosk. Features and limits vary by subscription tier as described on our pricing page.

2. Accounts

• You must provide accurate registration information and keep your login credentials secure.
• You are responsible for all activity that happens under your account.
• You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account.
• Notify us promptly at support@librarykeeper.org if you suspect unauthorized use of your account.

3. Subscriptions and billing

• Some features require a paid subscription, billed monthly in advance through our payment processor, Stripe.
• You can upgrade, downgrade or cancel your subscription at any time; changes take effect according to the billing cycle in place at the time.
• Fees are non-refundable except where required by law or explicitly stated otherwise.
• We may change subscription pricing with reasonable advance notice to active subscribers.

4. Your content and reader data

• You retain ownership of the catalog, reader/patron records, and other content you add to the Service ("Your Content").
• You grant us a limited license to host, store, process and display Your Content solely to provide and improve the Service.
• If you add records for readers who are minors, you represent that you have the appropriate authority and permission — for example, as a school, church, or homeschool co-op — to do so, consistent with our Privacy Policy.
• You are responsible for the accuracy and legality of Your Content, and for obtaining any consents needed from your readers to enter their data into the Service.

5. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law.
• Attempt to gain unauthorized access to the Service, other accounts, or our systems.
• Interfere with or disrupt the integrity or performance of the Service, including by excessive automated requests.
• Upload content that infringes someone else's intellectual property or violates their privacy rights.

6. Third-party services

The Service relies on third-party providers, including Stripe (payments), Microsoft Azure (hosting, storage, and AI-based book classification/search), an email delivery provider (transactional email), and ISBNdb (book metadata lookups). We are not responsible for outages or issues caused by these third-party providers.

7. Intellectual property

LibraryKeeper and its software, design, and branding are owned by us and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or underlying software beyond what is necessary to use the Service as intended.

8. Termination

You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your access if you materially breach these Terms, including non-payment, and will make reasonable efforts to notify you first except where immediate action is needed to protect the Service or other users.

9. Disclaimers and limitation of liability

The Service is provided "as is" and "as available," without warranties of any kind, express or implied. To the fullest extent permitted by law, LibraryKeeper will not be liable for any indirect, incidental, or consequential damages arising from your use of the Service, and our total liability for any claim will not exceed the amount you paid us in the twelve months before the claim arose.

10. Governing law

These Terms are governed by the laws of Minnesota, without regard to its conflict-of-law principles.

11. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, notify account holders by email.
